One of the Nirbhaya gang rape convicts of four filed Tuesday mercy plea before President Ram Nath Kovind following refusal of Supreme Court to stay his execution.
All the four are scheduled to be hanged on January 22 in Tihar jail. Their death warrant was issued on January 7 by a Delhi court.
Mukesh and Vinay filed curative petitions to escape the capital punishment. Their lawyer said the same would be filed on behalf of other two, Akshay and Pawan, soon.
Meanwhile, Mukesh has also approached a Delhi court for quashing the death warrant. The petition could be taken up on Wednesday.
According to Director General (Prisons) Sandeep Goel, the mercy plea was moved in the evening following dismissal of curative petition by Supreme Court.
Nirbhaya’s mother Asha Devi said, “Today is a big day for me because I have been struggling for seven years, till date. Today is a big day for me but the biggest day would be January 22 when the four would be hanged.”
She added that other available remedies would be rejected in the same way and all the four will be hanged on the scheduled day.
Lawyer of the convicts said he has approached the Tihar jail to collect conduct of the four during their stay from 2012 to 2019. Following it he would file curative petitions for Pawan and Akshay.
On the night of December 16 and 17 in 2012 a 23-year-old paramedic student was gang raped and murdered by these six people on a moving bus and thrown out on the road. Referred as Nirbhaya, she died on December 29 at Mount Elizabeth Hospital in Singapore.
